OLD LYME ZONING COMMISSION
MINUTES OF PUBLIC HEARING
Monday, April 9, 2007


The Old Lyme Zoning Commission held a Public Hearing on Monday, April 9, 2007 at 7:30 p.m. in the Auditorium of Memorial Town Hall.  Members present were Ted Kiritsis (Chairman), Tom Risom (Vice Chairman), Jane Marsh (Secretary), Jane Cable, John Johnson, Howard Tooker (Alternate) and Steve Ames (Alternate).   Also present was Ann Brown, Zoning Enforcement Officer.

Chairman Kiritsis called the Public Hearing to order at 7:32 p.m.  

1.      Special Exception Application to construct a dock, 24 Neck Road, Rob Shickel, applicant.

Ms. Marsh noted that Mr. Shickel was again in New York and not able to make the meeting.  The Commission agreed to conduct the Public Hearing.  Chairman Kiritsis noted that the application was opened at the March Regular Meeting.  Ms. Marsh read the exhibit list and Mr. Metcalf’s letter for the record.  Mr. Shickel arrived at this time.  He explained that they have addressed all of Mr. Metcalf’s comments on the revised plans, which he submitted.  Mr. Shickel stated that Mr. Gates will provide the live stamp as requested by Mr. Metcalf.  He noted that the revised plan shows conduit for the lighting.  Mr. Shickel provided the Commission with specifications for the lights, noting that they are 10-watt down lit lights.  He stated that the lights will be on every other piling on the fixed pier, but not the ramp.  Mr. Shickel stated that there will be a total of three lights.

Mr. Shickel provided the Commission with a copy of the Army Corps approval which was marked Exhibit M.  He stated that the live stamp and any other changes that the Commission may ask for will be provided on the final plan.  

Mr. Johnson reiterated that there will be no lighting on the path or ramp.  Ms. Marsh marked the revised site plan Exhibit N.  Mr. Shickel stated that there is currently a dock on the property, which the DEP requires, as part of their approval, to be removed.

No one present spoke in favor of or against the application.  Hearing no further comments, Chairman Kiritsis asked for a motion to close the Public Hearing.

A motion was made by Jane Cable, seconded by John Johnson and voted unanimously to close the Public Hearing for the Special Exception Application to construct a dock, 24 Neck Road, Rob Shickel, applicant.

2.      Special Exception Application to construct a dock, 12-1 Bank Road, Rob Shickel, applicant.

Mr. Shickel was present to explain the application.  Ms. Marsh noted that the legal notice was read at the March meeting.  She read the exhibit list for the record.

Mr. Shickel explained that the plans have been revised to address Mr. Metcalf’s comments.  He provided the revised site plan to the Commission which was marked Exhibit H.  

Mr. Shickel noted that the dock does not have a float or a ramp and the total length of it is 30 feet; three 10-foot sections.  He noted that the marina further up the Four Mile River had a great deal of concern because when the tide is up the channel is very narrow.  Mr. Shickel stated that they spent a good deal of time working with the marina to be sure that they understood where the channel was.  He noted that part of the agreement is that the maximum size of a boat to be docked cannot be larger than 8’ in beam and 20’ in length.  Mr. Shickel stated that this note is shown on the plan.  Mr. Ames questioned whether the Commission should accept a private agreement between to private owners on a waterway.  Ms. Cable stated that it is not accepting an agreement, it is imposing a condition.  Mr. Shickel noted that the property to the west has a larger dock and has a boat that sits partially in the channel, which is the genesis of the problem.

Mr. Shickel stated that there will be three lighting fixtures on the fixed pier.  He noted that these will be 10-watt down lit lights.  Mr. Shickel explained that the reason the access is over toward the north side of the property is because the vegetation can be walked on during times of high water.  He noted that there will be no other pathway.  Mr. Shickel stated that Mr. Metcalf also asked for the Army Corps of Engineers permit which he submitted for the record.

Mr. Shickel stated hat the live stamp, along with any additional items the Commission may request, will be provided on the final plan.  He stated that Mr. Metcalf requested another set of piles for the purpose of adding strength to the davits for lifting a boat.  He Mr. Shickel stated that with the Commission’s approval they would like to add one set of piles to the north side and one pile to the south.

No one present spoke in favor of or against the application.  Hearing no further comments, Chairman Kiritsis asked for a motion to close the Public Hearing.

A motion was made by John Johnson, seconded by Jane Marsh and voted unanimously to close the Public Hearing for the Special Exception Application to construct a dock, 12-1 Bank Road, Rob Shickel, applicant.

3.      Special Exception/Coastal Site Plan Application to construct an Office Complex, 2 Huntley Road, BGP Development, Inc., applicant.

Chairman Kiritsis noted that the applicant has requested that this hearing be continued to the May Regular Meeting.  Ms. Brown noted that the applicant has sent a letter granting an extension to the May 14, 2007 Meeting to continue the Public Hearing.

A motion was made by Jane Cable, seconded by John Johnson and voted unanimously to close the Public Hearing for the Special Exception/Coastal Site Plan Application to construct an Office Complex, 2 Huntley Road, BGP Development, Inc., applicant.

The Public Hearing adjourned at 9:35 p.m. on a motion by Jane Cable, seconded by John Johnson and voted unanimously.
